2. Scope of These Terms
These Terms govern:
- the purchase of jewellery and related products through the Omalgami online store;
- the rights and obligations of customers and the seller;
- the use of the Omalgami website;
- contracts concluded through distance communication.
These Terms apply exclusively to consumer purchases unless expressly agreed otherwise.
If the customer purchases products in connection with their business activities, certain provisions relating to consumer protection may not apply.
3. Products
Omalgami creates original handcrafted jewellery designed by Olga Beleacova.
Many products are individually handmade using precious metals, gemstones, pearls, enamel and other carefully selected materials.
Because each piece is handcrafted, minor differences in:
- colour;
- texture;
- finish;
- dimensions;
- gemstone appearance;
- natural inclusions;
are inherent characteristics of handmade jewellery and shall not be regarded as defects.
Product photographs are intended to represent products as accurately as possible. However, colours and appearance may vary depending on display settings and the natural characteristics of materials.
4. Product Availability
Products displayed on the website are subject to availability.
Some jewellery pieces are immediately available for dispatch.
Others are created only after an order has been placed.
If an ordered product becomes unavailable due to circumstances beyond our control, we will contact you without undue delay and offer one of the following options:
- cancellation of the order with a full refund;
- an alternative product;
- an updated production schedule.
5. Handmade & Bespoke Jewellery
Certain products offered by Omalgami are individually created according to customer specifications.
These include:
- custom jewellery;
- personalised jewellery;
- engraved jewellery;
- bespoke commissions;
- jewellery produced according to individual customer requirements.
Before production begins, customers may receive sketches, visualisations or quotations for approval where appropriate.
Production begins only after confirmation of the agreed design and payment where required.
Because bespoke jewellery is produced specifically for an individual customer, such products cannot normally be cancelled or returned after production has commenced, except where mandatory consumer protection legislation provides otherwise.
Customers are responsible for verifying all measurements, inscriptions, gemstone selections and other personalised specifications before approving production.
6. Orders
All product listings on the website constitute an invitation to submit an order and do not constitute a legally binding offer.
By placing an order, the customer submits an offer to purchase the selected products.
The order process includes:
- selecting products;
- providing billing and delivery information;
- the delivery address and agreed delivery method;
- selecting a payment method;
- reviewing the order before submission.
Before completing an order, customers have the opportunity to review and correct any errors in the information entered.
After an order has been submitted, Omalgami will send an automatic confirmation acknowledging receipt of the order.
This automatic confirmation does not constitute acceptance of the order and does not create a purchase contract.
A purchase contract is concluded only when Omalgami expressly confirms acceptance of the order by email.
We reserve the right to refuse or cancel an order if:
- payment cannot be successfully processed;
- product information contains an obvious pricing or description error;
- fraud or unauthorised activity is suspected;
- the product is unavailable;
- fulfilment has become impossible due to circumstances beyond our reasonable control.
If payment has already been received for a cancelled order, the full amount paid will be refunded without undue delay.
For bespoke jewellery, Omalgami may provide an individual quotation before accepting the order.
The purchase contract for bespoke jewellery is concluded only after the customer accepts the quotation and Omalgami confirms the order.
7. Prices
All prices displayed on the Website are shown in the selected currency and are valid at the time the order is placed.
Unless otherwise stated, prices include Value Added Tax (VAT) where applicable under Czech law.
Shipping costs, insurance, customs duties, import taxes or any other charges are displayed separately during the checkout process or are payable by the customer where applicable.
Omalgami reserves the right to change product prices at any time. Such changes shall not affect orders that have already been accepted.
If an obvious pricing error occurs due to a technical malfunction or human error, Omalgami reserves the right to cancel the order before the purchase contract is concluded. In such cases, any payment received will be refunded in full.
8. Payment Terms
Customers may choose from the payment methods available during checkout.
Available payment methods may include:
- Credit or debit card;
- Bank transfer;
- PayPal;
- Other secure payment methods displayed on the Website.
Payment must be successfully completed before production or shipment begins.
For custom-made or bespoke jewellery, Omalgami reserves the right to require full payment or a non-refundable deposit before production starts.
If payment is not completed within the specified period, Omalgami reserves the right to cancel the order.
9. Shipping & Delivery
Omalgami delivers jewellery worldwide where legally permitted.
The delivery method and shipping service are agreed with the customer before the order is dispatched. Shipping costs depend on the destination and selected delivery service and will be confirmed with the customer before shipment.
Orders are dispatched only after payment has been successfully received and, where applicable, after production has been completed.
Estimated delivery times are provided for guidance only. The actual delivery time may vary depending on the selected delivery service and circumstances affecting the shipment.
Once an order has been shipped, the customer will be notified via email or another agreed communication channel, such as a messaging service. Where tracking is available through the selected delivery service, the tracking information will be provided to the customer.
Delivery times may be affected by circumstances beyond Omalgami’s reasonable control, including but not limited to:
- customs clearance;
- carrier delays;
- adverse weather conditions;
- strikes;
- force majeure events.
Omalgami will inform the customer of any significant delay where appropriate.
The customer is responsible for ensuring that the delivery address provided is accurate and complete.
If an order is returned due to an incorrect or incomplete delivery address provided by the customer, refusal of delivery or failure to collect the shipment, Omalgami may charge the customer any reasonable additional shipping costs actually incurred, to the extent permitted by applicable law.
The risk of accidental loss or damage to the goods passes to the customer upon delivery of the goods to the customer or to a person designated by the customer, subject to applicable law.
Ownership of the goods transfers to the customer upon full payment, subject to applicable law.
10. Customs Duties & International Orders
Orders shipped outside the Czech Republic or the European Union may be subject to customs duties, import taxes, VAT or other governmental charges imposed by the destination country.
These charges are the sole responsibility of the customer unless expressly stated otherwise.
Omalgami has no control over customs procedures or fees and cannot predict the amount of such charges.
Customers are responsible for complying with all applicable import regulations in their country.
Refusal to pay customs duties or import taxes does not constitute a valid reason for cancelling the purchase contract.
11. Right of Withdrawal

To exercise your right of withdrawal, you may complete and submit our online Withdrawal Request Form available here

12. Returns & Refunds

The customer is responsible for the direct cost of returning the goods unless:
- the goods are defective;
- the incorrect product has been delivered;
- applicable law provides otherwise.
Customers are advised to use an insured and trackable shipping service when returning jewellery. Omalgami is not responsible for returned items lost or damaged during transit before they are received.
Refunds will be made using the same payment method used for the original transaction unless another method has been expressly agreed.
In accordance with applicable legislation, Omalgami may withhold reimbursement until:
- the returned goods have been received; or
- the customer provides proof that the goods have been sent back,
whichever occurs first.
Where required by law, the original standard delivery costs paid by the customer will also be refunded.
If the returned jewellery shows signs of use beyond what is necessary to determine its nature, characteristics and functioning, Omalgami reserves the right to reduce the refund by the amount corresponding to the diminished value of the goods, as permitted by applicable law.
13. Complaints & Warranty
Omalgami is responsible for ensuring that all products conform to the purchase contract at the time they are delivered.
